This Privacy Policy, together with the Terms & Conditions, sets out the basis on which 121tribe processes your personal data.

Introduction

We define a “Member” as any individual who accesses and uses our services. Any individual who wants to become a Member must be of 18 years or older.

According to the data privacy legislation, personal data represents any information relating to an identified or identifiable natural person. An identifiable person is the person that may be identified directly or indirectly.

This Privacy Policy regards the personal data belonging to our customers, our club members, our potential customers, the visitors of the 121tribe website, the recipients of our newsletters and commercial communications, and it applies to such data collected through our website or app, as well as to all other personal data we collect through e-mail or by any and all off-line methods.

If you are not a Member we will have to process your personal data in order for you to benefit from our services. We understand the importance of data privacy and in order to ensure the lawfulness of the data processing, we will inform you on all data processing aspects, your rights and options. The mechanism we implemented in this regard will allow you to consent to the processing of your personal data in order to benefit from our services as well as consent only for the marketing communications you are comfortable with. 

Information we collect, use and store

Information you give to us

  • Name and surname of Members;

  • E-mail address;

  • GPS coordinates;

  • Your profile on social platforms.

The above listed personal data is processed on a contractual basis, pursuant to the provisions of article 6 letter b) of the EU Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”)

121tribe will also process the personal data belonging to its Members in order to comply with legal obligations, pursuant to the provisions of article 6 letter c) of GDPR.

121tribe will process your data for marketing purposes only if you expressly consent to such processing, respectively by granting consent through the consent collection mechanism implemented in the Member account or by signing a consent form, pursuant to the provisions of article 6 letter a) of GDPR.

  • Usage Information: we collect information about your actions on the 121tribe website and/or mobile app, such as the type of content you view or the frequency and duration of your visits;

  • to provide you electronically with our specialized newsletters and commercial communications;

  • to carry out marketing campaigns;

  • to ensure the enforcement of this Privacy Policy, of our Terms & Conditions, including to ensure compliance with applicable laws and regulations and to protect the rights, property or safety of the 121tribes website.

We use and store your information only for the purposes mentioned above and limited in time to three years after the end of the contractual period or limited to the required period of time for each specific purpose, according to the applicable legislation.

Employees, contractors and agents of 121tribe have access to any personal information which we collect, but their use shall be limited to the performance of their duties and in line with the reason for processing. Our employees, contractors and agents who have access to your personal information are required to keep that information confidential and are not permitted to use it for any purposes other than to enable you to access and enjoy the 121tribe services, as well as use the 121tribe website.

Deactivate your account

At the end of your contractual period, we reserve the right to automatically deactivate your account and the personal data you gave to us will be deleted. 

Sharing and disclosure

By accessing our website, you expressly consent to us using, storing, sharing or disclosing any of your personal data. By sharing or disclosing personal data, you agree that the wellness club can do so with its successors, third-party websites or any other third-parties (e.g. Google Analytics). You may, at any time, withdraw your consent for future use, storage, sharing or disclosing of your personal data. However, please note that withdrawing your consent only operates for future processing of your personal data and it will not affect the lawfulness of processing already carried out.

In order to comply with local laws, regulations and legal requests, the wellness club reserves its right to use, store, share or disclose your personal data, if is necessary. This includes, but is not limited to, addressing security issues, technical problems, fraud, the protection of 121tribes’s rights. In this regard, none of the provisions found in the Terms & Conditions and Privacy Policy are meant to be a waiver of 121tribes’s rights, a limitation of our legal defences in any way or of the access to the necessary legal proceedings.

In accordance with the applicable legal provisions with regard to the processing of personal data and the free movement of such data, 121tribe undertakes to respect the rights of the data subject. You have the right of access to your data, the right of rectification of your personal data, the right to erase your personal data, the right to data portability and the right of restriction of processing your personal data. 

Furthermore, you have the right not to be subject to an automated individual decision and you are entitled to lodge a complaint with the supervisory authority.

121tribe is keen to take all necessary actions to protect your personal data against unauthorized access, loss, destruction or undesired alteration.

Your password (pin number) is meant to protect your 121tribe account, so we strongly recommend you to use a unique and strong password, limit access to your computer and browser, and sign off after having used your account.

Even if we continuously implement and update our administrative, technical and physical security measures to ensure protection of your personal data, we cannot guarantee the security of the transmission or storage of your information in the Internet environment at any time.

121tribe displays on the website and its app third party advertisements and other related content which links to third party websites. We cannot control or be held liable for the privacy policies and content of any third parties. We advise you to read their privacy policies to learn how they collect and process your personal data.

Updates to this Privacy Policy

We may need to revise this Privacy Policy in future. In case we amend the Privacy Policy, we will post the revised Privacy Policy on the website and signalize the updated version by changing the “Last updated” date at the top of the Privacy Policy. After the date the updated Privacy Policy becomes effective the continued access of our website will represent your acceptance of the respective updated Privacy Policy.
